These Terms of Sale (the "Terms") govern the sale of products by Studio DRÈA ("we," "our," "us," or “Seller”) through our website (the "Site"). By placing an order through the Site, you (or “Buyer”) agree to be bound by these Terms.

1. Orders and Acceptance

1.1 Placing an Order

By placing an order on our Site, you are making an offer to purchase the products in your order. We reserve the right to accept or decline your order at our sole discretion. The Buyer declares that the purchase of products on the Site is solely for personal use and not related to any commercial activity.

1.2 Order Confirmation  

Once your order is placed, you will receive an order confirmation email with the details of your order. This email is not an acceptance of your offer but merely confirms that we have received your order. Your order will be processed once payment is successfully completed.

1.3 Order Cancellation  

We reserve the right to cancel your order at any time for reasons including but not limited to stock availability, payment issues, or suspected fraud. If your order is canceled, you will be notified, and any payments made will be refunded to your original payment method.

2. Product Availability

2.1 Stock and Availability  

We strive to provide accurate product descriptions and availability information. However, due to high demand, stock levels may change. If an item is out of stock after your order is placed, we will inform you promptly and offer alternatives, a refund, or the option to wait for restocking.

2.2 Product Descriptions  

We take reasonable care to ensure the accuracy of product descriptions, images, and prices on the Site. However, we cannot guarantee that all content is free from errors or that products are exactly as shown on your screen due to differences in device displays and lighting conditions.

3. Pricing and Payment

3.1 Prices  

All prices listed on our Site are in Euros (EUR), unless otherwise specified. Prices may be subject to change without prior notice. The total price, including applicable taxes, shipping fees, and any other charges, will be displayed at checkout before you complete your purchase.

The prices of products displayed on the site are as follows:

• For metropolitan France: Prices include all applicable taxes (TTC) in Euros, reflecting the VAT rate in effect on the order date.
• For the European Union (EU): Prices include all applicable taxes (TTC) in local currency, reflecting the VAT rate of the shipping destination.
• For countries outside the EU: Prices are displayed excluding taxes (HT) in local currency. Additional costs such as import duties, customs fees, and local taxes are the responsibility of the Buyer and may be charged at checkout or upon delivery, depending on local regulations. Currency conversion is handled by the Buyer’s bank at the prevailing exchange rate.
• Delivery costs are not included in the product price and will be added at checkout unless otherwise specified.

3.2 Payment Methods

If your payment method is based in a currency other than Euros, your bank or payment provider may apply a conversion fee. All payments are processed in Euros, and any currency conversion will be handled by your bank or payment provider.

4. Shipping and Delivery

4.1 Worldwide Shipping 

We offer worldwide shipping. We offer free shipping to some European countries. For other countries, the shipping cost will be calculated at checkout based on your delivery address and the weight of your order.

4.2 Shipping Methods and Delivery Time 

We offer various shipping options, with estimated delivery times displayed at checkout. Please note that these are estimates and may be affected by customs processing, carrier delays, or other external factors.

Orders are typically processed within 1-2 business days (excluding weekends and public holidays). Estimated delivery times are:

• France: 1-2 days
• Europe: 2-6 days
• Other countries: Displayed at checkout

For faster delivery, express shipping is available for an additional fee. Delivery times and costs will be displayed at checkout. Please allow extra time for international orders or during peak seasons.

4.3 Customs and Import Duties

For international orders, outside the EU, duties and taxes are not included in the final price. International shipments may incur additional charges upon arrival, which are the responsibility of the recipient. We recommend checking with your local customs office for further details before placing an order.

If an international delivery—particularly to a country with customs duties—is refused by the Buyer for any reason, the Seller reserves the right to deduct the return shipping costs and any applicable customs fees from the refund amount. These costs will be calculated based on the actual expenses incurred for the return of the product to its country of origin.

4.4 Shipping Restrictions

We do not ship to certain restricted or embargoed countries. If your order cannot be shipped due to such restrictions, we will notify you and issue a refund.

5. Right of Withdrawal / Cancellation

5.1 Right of Withdrawal  

Under French law, consumers have the right to cancel their order and return the products within 14 days from the date they receive the products without providing a reason. This is known as the right of withdrawal.

5.2 How to Exercise the Right of Withdrawal

To exercise your right of withdrawal, please use the option for return an order at our website or contact us at customercare@studiodrea.com within 14 days of receiving your order. You can use the standard withdrawal form (available at the end of this section) or provide a clear statement that you wish to cancel the contract.

To express their intent to withdraw from a purchase, the Buyer must provide prior notification of their decision or follow the return option on the website. Simply returning the Products or refusing delivery is not sufficient.

5.3 Return Instructions

Once we receive your cancellation request, we will send you instructions on how to return the products. The products must be returned in their original, unused condition, including all packaging.

5.4 Return Shipping Costs

Unless the item is defective or incorrect, the Buyer is responsible for the cost of returning the item. For customers in eligible countries, Studio DRÈA offers free returns. For all other destinations, the return shipping cost will be partially subsidized, and the Buyer will only be required to pay the difference, as outlined in the return policy.

5.5 Refunds

Once the returned product is received and inspected, the return will be processed within 7 days. The refund will be issued to the original payment method, minus any applicable shipping or customs fees, in accordance with our return policy.

6. Product Warranty

6.1 Legal Warranty of Conformity  

Under Article L.217-3 of the French Consumer Code, the Seller is responsible for any conformity defects that exist at the time of delivery and appear within two (2) years.

As per Article L.217-4, a product complies with the contract if it:

1. Matches the description, type, quantity, and quality specified, including functionality, compatibility, and other characteristics;

2. Is fit for any special use the consumer informed the Seller of before or at the time of purchase;

3. Comes with all required accessories and instructions;

4. Is updated as stipulated in the contract.

Examples of non-compliant products include:

• Wrong model or color received (e.g., ordering Bag No. 1 and receiving Bag No. 3 or a different color);

• Quality issues, subject to Customer Service validation with photos.

Under Article L.217-7, defects appearing within twenty-four (24) months from delivery are presumed to have existed at the time of delivery, unless proven otherwise or incompatible with the product’s nature.

6.2 Warranty Claims 

Under the legal guarantee of conformity, the Buyer:

• Has two (2) years from delivery to take action;

• Can choose between repair or replacement of the product (unless the requested remedy is impossible or involves disproportionate costs, as per Article L.217-12 of the Consumer Code), or, if these are not possible, a price reduction or contract termination;

• Is not required to provide proof of the conformity issue within the first twenty-four (24) months following delivery.

The legal guarantee of conformity applies regardless of any commercial warranty offered.

Additionally, the Buyer may invoke the guarantee for hidden defects as per Article 1641 of the Civil Code, with the option to choose between contract termination or a price reduction, as outlined in Article 1644 of the Civil Code.

Under Article 1644 of the Civil Code, if the legal guarantee for hidden defects is invoked, the Seller will, at the Buyer's choice and within the legal deadlines:

• Refund the full price if the Buyer returns the product, or

• Refund part of the price if the Buyer keeps the product.

To make a warranty claim, please contact us at customercare@studiodrea.com and provide proof of purchase, a description of the defect, and any relevant images if possible. We will assess your claim and arrange for a remedy.

7. Customer Responsibilities

7.1 Account Information

You are responsible for maintaining accurate and up-to-date information in your account, including shipping address and contact details. Please ensure your details are correct before completing your purchase. We are not responsible for delays or undeliverable packages due to incorrect addresses or information.

7.2 Delivery Acceptance  

By placing an order, you agree to accept delivery of the products at the provided shipping address. If you are unavailable to receive the delivery, the carrier may leave a notice or attempt re-delivery.

7.3 Customs Compliance

You are responsible for ensuring compliance with all applicable laws and regulations in your country, including customs and import regulations.

8. Limitation of Liability

8.1 General Disclaimer 

To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of our Site or the purchase of our products. The Seller disclaims all responsibility for any direct or indirect damages arising from the use and/or access to the Site (including inaccessibility, data loss, deterioration, destruction, viruses, or system failures). Users are solely responsible for taking appropriate measures to protect their data and software from any potential harm while using the Site. Any User’s connection to the Site is at their own risk.

We reserve the right to temporarily suspend access to the Site without notice, particularly for necessary updates, maintenance, or due to technical issues.

The Seller shall not be held liable for any events that disrupt or hinder access to the Site, in whole or in part (e.g., site access interruptions, bugs, malfunctions, or other technical problems).

8.2 Product Issues

If you receive a defective product or if the product does not conform to the contract, please contact us immediately at customercare@studiodrea.com. We will assess the situation and, if applicable, provide a solution such as a replacement, repair, or refund, in accordance with our terms and applicable laws.

The Products available on the Site comply with current French and European standards.

The Seller shall not be held liable in the following cases:

• Loss or damage to the Product after delivery to the Buyer;

• Improper use of the Product by the Buyer;

• Failure to maintain the Product or maintenance not in accordance with the Seller's recommendations;

• Improper storage of the Product by the Buyer;

• Allergies to materials or components of the Products as indicated in the product description.

9. Force Majeure

In the event of a force majeure, preventing or delaying the execution of the order or these Terms of sales, we will inform the Buyer as soon as possible by email and will be released from our obligations described in these Terms for the entire duration of the force majeure event, without any compensation to the Buyer.

In accordance with Article 1218 of the Civil Code, any event beyond our control, preventing us from executing the order, which could not reasonably be foreseen at the conclusion of the contract and whose effects cannot be avoided by appropriate measures, is considered a case of force majeure.

10. Reservation of title

We retain full ownership of the Product sold until the full price, including fees, taxes, and mandatory contributions, is fully paid.

11. Intellectual property

The brand and all illustrations, images, logos, and sound elements appearing on the Products and/or our Site, as well as their accessories or packaging, whether registered or not, are and will remain our exclusive property. Any total or partial reproduction, modification, or use of these marks, illustrations, images, logos, and sound elements, for any reason and on any medium, without our prior express consent, is strictly prohibited. The same applies to any combination or conjunction with any other mark, symbol, logo, sound elements, or any other distinctive sign intended to form a composite logo. The same applies to all copyrights, designs, models, and patents that belong to us.

The use of all or part of the Site, particularly by downloading, reproducing, transmitting, or representing it for purposes other than personal, private, non-commercial use is strictly prohibited. Violation of these provisions exposes the violator to the sanctions provided by the Intellectual Property Code for copyright and trademark infringement, as well as by the Civil Code concerning civil liability.

Creating hypertext links to any page or element of the Site can only be done with our prior written authorization, which may be revoked at any time. Websites with a hypertext link to our Site or to which our Site may refer are not under our control, and we disclaim all responsibility for the access to and content of these websites.

12. Personal Data

By placing an Order on the Site, the Buyer agrees that we collect, use, and process the personal information provided (such as names, date of birth, postal address, email address, bank details, and password) necessary to process, manage, track, deliver, and invoice the Order, in compliance with the amended Data Protection Act of January 6, 1978, and the General Data Protection Regulation (GDPR) No. 2016-679.

The purposes and conditions under which we collect and process personal data are outlined in our "Privacy Policy" and "Cookie Policy," both accessible on the Site.

13. Governing Law

These Terms of Sales are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.

We reserve the right to modify or update these Terms of Sale at any time.
